MayaCraft LLC - Terms of Service
Please read these terms carefully before using MayaCraft services.

  1. Company Information
    MayaCraft LLC is a limited liability company organized under the laws of the United States.

MayaCraft provides digital services including VPS hosting, Minecraft hosting, game server hosting, dedicated or virtual infrastructure, web hosting, server management, IP and network-related services, reseller hosting, software, digital services, and other hosting and infrastructure-related products. The exact services available may change at any time.

  1. Acceptance of Terms
    By creating an account, placing an order, making a payment, or using any MayaCraft service, you agree to these Terms.

You must provide accurate and current information. You are responsible for maintaining the security of your account, passwords, API keys, server credentials, and other authentication information, and for all activity performed through your account unless you can demonstrate unauthorized use not caused by your negligence.

MayaCraft may request additional information for fraud prevention, payment verification, abuse investigations, or compliance purposes.

  1. Payments
    Prices are stated in the currency displayed at checkout. Unless otherwise stated, services must be paid in advance and may not be provisioned until payment is confirmed.

MayaCraft may use third-party payment processors, including Stripe. Processor fees, taxes, currency conversion fees, and other transaction costs may apply. Pricing may change at any time, but changes will not retroactively modify an already-paid billing period unless required by law.

Promotions, discounts, coupons, special offers, and account credits may have additional conditions. Credits are not automatically redeemable for cash unless required by law or approved by MayaCraft.

  1. Refund Policy
    MayaCraft offers a refund request period of 4 calendar days from the date of the original payment. The minimum refund request amount is €10. This €10 minimum is a MayaCraft policy and is not represented as a requirement imposed by Stripe.

Requests must be submitted through official MayaCraft support and include the customer name, account email, order or invoice ID, service concerned, and reason for the refund.

Refunds may be denied when requested after the 4-day period, below €10, after a Terms violation, following abuse, fraud, illegal activity, attacks, intentional infrastructure damage, malicious use, an active dispute or chargeback, previous refund-system abuse, material service consumption where a refund is not legally required, or in bad faith.

Approved refunds are generally issued through the original payment method. Processing times depend on the payment processor and financial institution. Stripe states that refunds can take approximately 5-10 days to appear. Nothing in this policy restricts mandatory consumer rights.

  1. Chargebacks and Payment Disputes
    Customers should contact MayaCraft support before initiating a payment dispute or chargeback when the issue can reasonably be resolved through support.

Fraudulent or abusive chargebacks may result in immediate suspension, account termination, cancellation of unused services, blocking of future purchases, and investigation of the associated account and transactions. MayaCraft may provide relevant information to payment processors, financial institutions, or authorities when reasonably necessary. A chargeback does not automatically entitle a customer to continue using a service for which payment was reversed.

  1. Service Availability
    MayaCraft attempts to provide reliable and continuous service but does not guarantee 100% uptime unless a separate written SLA explicitly provides such a guarantee.

Services may become unavailable because of hardware or network failure, data center outages, maintenance, DDoS attacks, upstream provider issues, software failures, security incidents, emergency maintenance, or events outside MayaCraft's reasonable control. Emergency maintenance may occur without prior notice when necessary to protect infrastructure or customer data.

  1. Prohibited Use
    MayaCraft services must not be used for illegal, fraudulent, abusive, malicious, or harmful activity.

Network Abuse
DDoS or DoS attacks, floods, reflection or amplification attacks, and network disruption.
Port scanning intended to facilitate attacks or attempts to bypass network security controls.
Attacks against third-party infrastructure.
Fraud and Abuse
Phishing, credential theft, carding, payment fraud, identity theft, scams, and fake payment confirmations.
Malware, ransomware, botnets, and malicious software distribution.
Cryptocurrency mining without explicit written authorization.
Spoofing and Illegal Content
IP, MAC, DNS, ARP, email, caller-ID, domain, network identity spoofing, forged headers, impersonation, and unlawful content or activity are prohibited.

  1. Reseller Policy
    Customers may resell eligible services where the specific product permits resale. Resellers remain responsible for their customers and their customers' activity. They may set pricing, market their business, provide first-line support, build panels or billing systems, and rebrand where technically and contractually permitted.

Resellers may not misrepresent infrastructure ownership, claim ownership of IP space or networks they do not own, forge or spoof IP addresses, abuse routing or BGP systems, impersonate an ASN or provider, conduct attacks, sell for illegal purposes, hide abusive activity, bypass abuse controls, or falsify billing or payment information. Repeatedly allowing abuse may result in suspension or termination.

  1. IP Addresses and Network Resources
    Assigned IP addresses remain the property or controlled resource of MayaCraft or its upstream provider unless explicitly stated otherwise in writing. Customers do not acquire ownership through use.

Customers may not transfer or sell IP addresses without authorization, announce unauthorized prefixes, manipulate routing, establish unauthorized BGP sessions, or use IP addresses for spoofing. MayaCraft may change or reassign IP addresses when reasonably necessary.

  1. Abuse Reports
    MayaCraft may investigate reports concerning spam, malware, DDoS attacks, scanning, phishing, fraud, copyright complaints, network abuse, security incidents, and other prohibited activity.

Customers must cooperate with reasonable investigations. Failure to respond to serious reports may result in suspension or termination. For severe incidents, MayaCraft may suspend a service immediately without waiting for confirmation.

  1. Suspension and Termination
    MayaCraft may suspend or terminate an account or service for Terms violations, overdue payment, suspected fraud, abuse, security risks, attacks or attempted compromise, illegal activity, circumvention of security controls, refund or chargeback abuse, missing verification information, or when required by a provider, data center, payment processor, court, or competent authority.

Termination for abuse or serious violations may occur immediately. Termination does not remove obligations that arose before termination.

  1. Data and Backups
    Customers are responsible for maintaining their own backups unless a separate backup service is explicitly purchased or included.

MayaCraft does not guarantee recovery after hardware failure, accidental deletion, account termination, filesystem corruption, software failure, customer configuration errors, or security incidents. Customers should maintain independent backups of important data.

  1. Customer Content
    Customers retain ownership of content they lawfully upload. By using MayaCraft services, customers grant MayaCraft the limited rights necessary to store, process, transmit, and technically operate that content to provide the purchased service.

MayaCraft may access or process information when reasonably necessary for technical support, security or abuse investigations, fraud prevention, legal compliance, or service operation.

  1. Intellectual Property
    MayaCraft branding, website, software, logos, designs, documentation, trademarks, and other company materials remain the property of MayaCraft LLC or their respective owners.

Customers may not copy, redistribute, sell, modify, or commercially exploit MayaCraft intellectual property without authorization. These Terms grant no ownership of MayaCraft intellectual property.

  1. Third-Party Services
    MayaCraft may depend on payment processors, data centers, network providers, software providers, DNS providers, cloud providers, and security providers. MayaCraft is not responsible for outages or failures caused exclusively by third parties outside its reasonable control. Third-party services may have their own terms and policies.

  2. Limitation of Liability
    To the maximum extent permitted by applicable law, MayaCraft LLC shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use or inability to use a service, including loss of profits, revenue, business, customers, data, reputation, or service availability.

MayaCraft's aggregate liability arising from a service is limited, to the maximum extent permitted by law, to the amount actually paid for the affected service during the applicable period. Nothing excludes liability that cannot legally be excluded or limited.

  1. Indemnification
    To the maximum extent permitted by law, customers agree to defend, indemnify, and hold harmless MayaCraft LLC, its owners, officers, employees, contractors, providers, and affiliates from claims, damages, liabilities, costs, and expenses arising from customer use of services, Terms or law violations, customer content, customer users, abuse originating from customer services, or fraudulent or malicious activity. This provision applies only to the extent permitted by law.

  2. Governing Law
    These Terms are governed by the applicable laws of the United States and the state in which MayaCraft LLC is organized, without regard to conflict-of-law principles, except where mandatory consumer protection laws require otherwise.

Disputes shall be handled in a court of competent jurisdiction in the applicable jurisdiction unless the parties agree otherwise or applicable law provides a different forum. Nothing prevents a consumer from exercising mandatory legal rights.

  1. Compliance With United States Law
    MayaCraft operates as a U.S.-organized business and may comply with applicable U.S. federal, state, and local laws. Customers must comply with laws applicable to their use of the services.

MayaCraft may cooperate with valid legal requests, court orders, law-enforcement requests, and binding legal processes, and may act to prevent fraud, abuse, security threats, or unlawful activity.

  1. Consumer Protection
    Nothing in these Terms removes rights that cannot legally be waived. Where applicable, customers may have statutory rights under consumer protection laws. Refund, cancellation, liability, and dispute provisions apply only to the extent permitted by applicable law.

  2. Honest Reviews and Feedback
    Customers may provide honest opinions about MayaCraft services. Customers may not use reviews or public statements to intentionally publish fraudulent information, impersonate another person, disclose confidential information, threaten individuals, or engage in unlawful conduct.

  3. Account Security
    Customers are responsible for protecting account credentials, using strong passwords, enabling available security features, protecting API keys, restricting server access, and keeping software reasonably updated. Suspected account compromise must be reported to MayaCraft as soon as reasonably possible.

  4. Changes to These Terms
    MayaCraft may modify these Terms from time to time. Updated Terms may be published on the MayaCraft website. Continued use after an updated version becomes effective constitutes acceptance to the extent permitted by law. Material changes may be communicated through reasonable means where required.

  5. Severability
    If any provision is found invalid, unlawful, or unenforceable, the remaining provisions remain in effect to the maximum extent permitted by law. The invalid provision will be interpreted or modified only as much as legally permitted to make it enforceable.

  6. No Waiver
    Failure by MayaCraft to enforce any provision does not waive the right to enforce that provision in the future.

  7. Entire Agreement
    These Terms, applicable service-specific agreements, acceptable use policies, privacy policies, invoices, and written agreements constitute the agreement governing use of the applicable service. If a written service agreement conflicts with these Terms, the specific written agreement controls to the extent of the conflict.

  8. Contact
    For support, billing questions, refund requests, abuse reports, or legal inquiries, customers should use the official MayaCraft support channels. MayaCraft may require account ownership verification before discussing account-specific information.

Final Acceptance
By purchasing or using any MayaCraft LLC service, you confirm that you have read and understand these Terms, agree to comply with them, will not use MayaCraft infrastructure for illegal or malicious activity, accept applicable payment, refund, service limitation, and reseller conditions, and understand that reseller activity remains subject to these Terms.
